1. BASIC CONCEPTS
1.1. E-shop moodyshadow.com is created and managed by self-employed under an individual activity certificate No 1083141, Ausra Bindariute, operating in accordance with the laws of the Republic of Lithuania – Seller.
1.2. Customer or Data subject - natural person - a customer of the Seller (including E-shop visitors) whose personal data is collected by the Seller.
1.3. E-shop – Sellers e-shop at moodyshadow.com.
1.4. Services – all services provided by the Seller.
1.5. Personal data - any information related to a natural person - a data subject whose identity is known or can be directly or indirectly established using such data as a personal identification number, one or more physical, physiological, psychological, economic, cultural, or social characteristics of a person.
1.6. Processing of personal data - any action performed with personal data: collection, recording, accumulation, storage, classification, grouping, merging, changing (addition or correction), provision, publication, use, logical and / or arithmetic operations, search, dissemination, destruction, or other action or set of actions.
1.7. Partner – a legal entity that provides services to the Seller related to the activities performed by the E-shop, or sells goods to it, or carries out joint projects with the Seller, including, but not limited to, marketing promotions, joint sales campaigns, loyalty programs, etc., in media, websites, e-shops, retail stores, retail chains, etc.

1.11. Account – the main data of the Customer's login to the e-shop, which consists of one e-mail address and a Password.
1.12. A password is a unique combination of numbers, letters, or numbers and letters or other symbols created by the Customer, after entering which it is possible to log in to the e-shop.

2. GENERAL CONDITIONS
2.1. The Customer grants the Right to the Seller to carry out all the processing of Personal Data to the extent and for the purposes provided for in this Privacy Policy.
2.2. Personal data is processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing and protection of Personal Data, this Privacy Policy.
2.3. Personal data in the E-shop is processed in accordance with the following principles:

2.4. It is considered that the Customer, when purchasing in the E-shop, has read the Privacy Policy of the current version and agrees with it. If the Customer does not agree with any part of the Privacy Policy or the Privacy Policy, then in this case the Customer must not place an order and do not buy the product in the E-shop.
2.5. The Privacy Policy can be accessed in the E-shop and printed at any time. The Privacy Policy may be amended, filled in or updated at the Sellers discretion. The new version of the Privacy Policy is published in the E-shop.
2.6. The Customer can place an order in the E-shop without registration, or through his Account by registering in the E-shop.
2.7. During the initial registration at the E-Shop via the Account, the Customer must provide his e-mail address and come up with a secure Password, as well as provide accurate Personal Data to the E-shop. The Customer is responsible for their correctness. After creating an Account, the Customer is assigned an identification code.
2.8. When using the Services, as well as when making purchases in the E-shop, the Customer must always provide accurate Personal Data to the E-shop and is responsible for their correctness.
2.9. The Customer has the right to change and supplement personal data in the Account at any time or to apply to the e-shop with a request to delete the Account.
2.10. The Customer must not disclose the Password to third parties and store it, otherwise all related responsibility lies with the Customer.

3. COLLECTION, USE, ADJUSTMENT AND STORAGE OF PERSONAL DATA
3.1. Sellers E-shop is hosted on the Wix.com platform. Wix.com provides with the online platform that allows to sell products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. The Seller respects the right to privacy of each Customer. Personal data of the Customer (i.e. name, surname, e-mail address, telephone number, address of delivery of the product / service, age / year of birth, payment data of the product / service (bank account no., method of payment, etc.), purchase history, as well as, with the consent of the Customer, age, gender, date of birth, place of residence) are collected and processed for the following purposes:
3.1.1. For the purpose of e-commerce. The following Personal Data is processed: name, surname, e-mail address, telephone number, delivery address of the product / service, age / year of birth, IP address, payment data of the product / service. The duration of storage of personal data used for the purpose of e-commerce is 5 (five) years from the date of the last login to the e-shop.
3.1.2. For the purpose of direct marketing. The following Personal Data is processed: name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence. The duration of storage of personal data used for the purpose of direct marketing is 5 (five) years from the date of the last login to the e-shop.
3.2. The Customer may give consent to the processing of his / her Personal Data (name, surname phone number, e-mail address, address, age, gender, date of birth, place of residence) for the purpose of direct marketing. If, having given his consent to the processing of his data for the purpose of direct marketing, as well as to receive Direct Marketing Messages, the Customer will not later wish to do so and will inform the Seller about it, the Seller will no longer process his Personal Data for the purpose of Direct Marketing and will not send any electronic news to the Customer, except for information related to the Customer's order.
3.3. The Customer has the right to withdraw his consent to the Seller in clause 3.2 to process the Customer 's Personal Data for the purpose of direct marketing at any time by submitting a corresponding notification to the Seller by e-mail ask@moodyshadow.com and clearly indicating that he withdraws his consent to the use of his Personal Data for the purpose of direct marketing and does not wish to receive any Direct Marketing Messages.
3.4. The Customer also has the opportunity to refuse to implement his right to object to the processing of the Customer’s Personal Data for the purpose of direct marketing by clicking on the appropriate link contained in each e-mail sent.
3.5. The Customer as the Data Subject, has the following rights related to the procedures for the processing of the Customer 's Personal Data:
3.5.1. to receive information from the Seller about the processing of the Customer 's Personal Data, to get acquainted with your Personal Data and how they are processed;
3.5.2. to receive information from the Seller, from what sources and what personal data of the Customer has been collected, for what purpose they are processed, to which data recipients are provided and provided at least in the last 1 (one) year;
3.5.3. to request to correct, destroy the Customer 's Personal Data or suspend, except for storage, the processing of your Personal Data when personal data is processed without complying with the provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania and other laws.
3.6. When exercising his rights, the Customer must provide a passport, identity card or driver's license. The Seller provides the Data Subject free of charge with information about the processed Personal Data of the Data Subject once a year. The Customer may exercise his/her rights provided for in clause 3.5 by applying by e-mail ask@moodyshadow.com. The Seller has the right to adjust, change, delete Personal Data or suspend the processing of Personal Data only after identifying the identity of the Customer who applied.
3.7. The Customer 's Personal Data is not provided to third parties, except in the following cases:
3.7.1. When the Customer 's consent is obtained, as specified in this Privacy Policy;
3.7.2. Personal data for e-commerce purposes are provided to partners who provide services to the Seller related to the activities performed by the Seller;
3.7.3. In the cases provided for by the laws and legal acts of the Republic of Lithuania to the competent authorities.
3.7.2. In the e-shop, payments are processed using Wix E-commerce platform. All direct payment gateways offered by Wix.com and used by E-shop adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
3.8. The Customer is aware of his right to object to the processing of his Personal Data for the purpose of direct marketing, i.e. The Customer has the right to express his disagreement immediately, or later.
3.9. The Customer agrees that his /her Personal Data will be transferred to the Partners when fulfilling the Customer's order placed in the E-shop, as well as when the E-shop provides services to the Customer, as well as to the E-shop Partners, as specified in 3.7. Point.
3.10. If the Customer does not agree with the Privacy Policy, the Customer will not have the opportunity to use the services of the e-shop.

3.12.
